July 17, 2011 /24-7PressRelease/ -- The Fourth District Court of Appeals of Florida recently upheld a damages award against Boomers Fun Park, which will likely include an additional approximately $400,000.00 in interest and costs. The law firm of Babbitt, Johnson, Osborne, & LeClainche, obtained a jury award of $2.29 million dollars, plus over $400,000.00 in court awarded attorney's fees and costs.

On cross examination, by partner Stephan LeClainche, the head of maintenance for Boomers admitted that he was negligent in maintaining the Rock Wall located at the Boca Raton fun park. When the second of two safety bolts that secured the belay system on the wall failed, Michael Livingston fell over twenty feet to the ground shattering his ankle and compressing two vertebrae in his back.

The final judgment including the interest and court awarded fees and costs, will likely total over $3.1 million dollars. This will cover all of Michael Livingston's current and future medical bills, as well as offsetting the costs of adapting his lifestyle to dealing with the permanent fusion of his right ankle. The case was tried by Stephan LeClainche and Rebecca Larson.
